Baku: A civil claim has been filed in the ongoing trial of Oleg Krapivin, a Ukrainian millionaire known in criminal circles as 'Oleg Bakinsky,' who was arrested in Azerbaijan on charges of hooliganism, alongside Konstantin Kucher.
According to Azeri-Press News Agency, the trial is being conducted at the Baku Court on Grave Crimes under the chairmanship of Judge Elnur Nuriyev. The latest hearing saw the victim's lawyer, Samir Isayev, presenting a case for compensation, stating that there has been no reconciliation between the parties and that the accused have neither apologized nor expressed remorse.
The victim, Valeriy Zakharenkov, is demanding 50,000 AZN from both defendants jointly for moral damages and material losses. Isayev emphasized that Zakharenkov, a businessman visiting a local establishment, was subjected to disrespect. Kucher's lawyer has claimed procedural violations during the preliminary investigation, but the prosecutor maintained that such issues are addressed during preparatory hearings, and evidence discussed in court would remain valid.
During the session, the court reviewed the civil claim, with the victim's lawyer urging the court to accept both material and moral damage claims. In defense, Kucher's lawyer, Elshad Hajiyev, argued that his client had no intent of embezzlement or fraud and had attempted to fulfill contractual obligations, citing factors beyond Kucher's control, such as the closure of "Gunay Bank" and border restrictions.
Oleg Krapivin has objected to the claim, stating, 'These people are framing me. I won't pay even 5 manats for made-up hooliganism, let alone 50,000.' Kucher also rejected the civil claim, leading to the trial being postponed until May 26.
Oleg Bakinsky was arrested in Baku last year for alleged hooliganism against a Russian citizen, charged under Article 221.3 of the Criminal Code for hooliganism committed with weapons or objects used as weapons, accompanied by violence or property damage. He was also later charged under Article 178.4 for fraud causing particularly large financial damage. Alongside Bakinsky, Konstantin Antonovich Kucher, a former Deputy Minister of Defense Industry for Aviation Affairs in Ukraine, has also been implicated in the case. The victims have been identified as "Aviazapchast" JSC, "Promyshlennye Postavki Kazakhstan" LLC, and Zakharenkov Valeriy Nikolayevich.
